Life and Health Insurance

If you have not received benefits promised by an insurance company for a life or disability claim you have the right to seek damages for breach of the insurance contract. You may also be entitled to recover damages for bad faith claim handling. If the insurance company has denied or delayed a compensable insurance claim intentionally knowing that it should pay such a claim, you may even be entitled to assert a claim for punitive damages.

Property Insurance Claims

If you are insured under a homeowners insurance policy or commercial property policy but the insurance company has not honored your claim for damages, you may be able to bring a lawsuit for breach of insurance contract. Under certain circumstances, you may also be able to assert a claim for bad faith claim handling or even punitive damages.

Insurance Producer Malpractice

If you have been advised that the insurance contracts that were in place at the time of a loss did not provide the coverage that you had ordered or the coverage that you were told you had, you may have a claim against your insurance producer for malpractice. “Gaps in coverage” or failure to place coverage can constitute a breach of an oral contract to procure insurance coverage.
